Public Hearing
Chairman Marco called the meeting to order at 7:30.  
PZC2012-14 Application 5 lot re-subdivision at 476 Tolland Turnpike & Meadow Lane (Maps 16 & 21 Lot 22 Zone R80 Owner/Applicant: Ridgeview Willington, LLC (Received March 6, 2012 Public Hearing April 17, 2012 Decision within 65 days after close of P.H.)
A letter from Jacobson & Associates dated 3/15/12 was submitted and read into the record by Chairman Marco.  
Arthur Godbout, the manager of Ridgeview Willington LLC, was present.  He said the land has been in his family for 44 years and was purchased in 1968.  There is a duplex and single family home on the site and they want to subdivide so they can sell the duplex and single family home.  The proposal is to subdivide the parcel into 5 lots; lot 1 is the duplex, lot 2 is the single family, lot 3 will be open space, lot 4 includes the driveway that leads to lot 5 and lot 5 is a large open parcel.  
The applicant presented the plan and showed an open space area which was 10% of the parcel.  The commission informed the applicant of the regulations requiring 40% open space for an open space subdivision and 20% for traditional.  A discussion was held on an Open Space Subdivision; anything greater than 25 acres has to be 40% open space unless the Commissison authorizes a traditional subdivision design.  The commission explained to the applicant that they could request a Traditional Subdivision but they would have to present both, an Open Space Subdivision and a Traditional Subdivision.  S. Yorgensen explained the application process and the public hearing in which the commission hears all the information presented.  A discussion was held on the regulations.  A. Marco read the Open Space Regulation to the applicant and a discussion was held on Open Space and Cluster Subdivisions.  
M. Ellis said, on the plans, the reserve field is outside the buildable square and the regulations require it to be in the buildable square.  
The commission informed the applicant of a Pre-Application Conference that can be held prior to the public hearing.  This would steer the applicant in the right direction but the owness is on the applicant and his consultant to read the regulations, see what applies to them and prepare their application in compliance with the regulations.  
The applicant said, if the plan has to be redesigned, there was no point in continuing the public hearing.  J. Poole explained the Yield Plan to the applicant.  E. Standish said the open space does not have to be dedicated to the town; it could be dedicated to an association or given for agricultural use.  
Chairman Marco asked for public comment.  Phil Monty of 16 Meadow Lane asked if the plans included putting a road through to 74.  Mr. Godbout said no, the numbers are just not there.  
The commission recommended the applicant thoroughly read the regulations and come back for a pre-application conference.  A discussion was held on application fees; of the applicant withdraws the application and re-applies; they will have to pay the fees again.  S. Yorgensen said the Commission has no authority to waive fees. The fee is set by ordinance. Any discussion of that would be with the Board of Selectmen. The applicant will submit a withdrawal of the application in writing.
M. Ellis motioned to close the public hearing.  P. Nevers seconded the motion.  All in favor.  Motion carried.  
Regular Meeting
Chairman Marco called the regular meeting to order at 8:27.  J. Poole was seated for J. Sullivan.  
New Business
PZC2012-29 Application for 2 lot subdivision at Jared Sparks Road (Maps 32/1A Lots 37/12 Zone R80) Owners/Applicant: Rebecca M Kimbriugh & Liesa M Fawell-Sienkowski (Received April17, 2012 Public hearing by June 19, 2012 decision within 65 days after close of P.H.)
A discussion was held on the application.  
M. Ellis motioned to set the public hearing for May 15, 2012.  E. Standish seconded the motion.  All in favor.  Motion carried.  
PZC2012-27 Application to Amend Special Permit & Site Plan to for utilities including electrical to pavilion at 511 River Road (Map 39 Lot 6 Zone R80) Owner/Applicant : Town of Willington (Received April17, 2012 Public Hearing or Decision by June 19, 2012)
A discussion was held on the original plan.  The commission would like to see a presentation on a complete plan.  A discussion was held on a public hearing.  
M. Ellis motioned to hold a public hearing on May 15, 2012.  E. Standish seconded the motion.  
A discussion was held on holding a public hearing vs. having the applicant coming in before the commission to present the application.  J. Poole said he would like to see a completed plan.  A discussion was held on lighting. T. Murphy said, as the applicant gets funding, they will add to the plan.  A discussion was held on the plan.  A. Marco suggested sending a letter requesting a presentation. S. Yorgensen will e-mail them regarding attendance at the hearing.  
A vote was held on holding the public hearing; J. Poole, E. Standish, P. Nevers, T. Murphy in favor, A. Marco opposed, M. Ellis abstained.  Motion carried.  Public hearing has been set for May 15, 2012.
A discussion was held on the well.  A discussion was held on the town presenting a complete application.  
Old Business
PZC2012-17 Application for 1 lot re-subdivision at 112 Willington Hill Road (Map18 Lot 62 Zone R80) Owner/Applicant: Melanie Ellis (Received March 6, 2011 Public Hearing April 3, 2012 decision by June 5, 2012.)

E. Standish motioned to approve PZC2012-17 Application for 1 lot re-subdivision at 112 Willington Hill Road with the following conditions: digital plans to be submitted pursuant to Section 4.02.2.  P. Nevers seconded the motion.  All in favor.  Motioned carried.
PZC2012- 18 Application Special Permit for gift shop, meditation room, Reiki & massage, special events for educational purposes, & Chiropractor’s /Acupuncture office at 8 Tolland Turnpike (Map 30 Lot 11 Zone DC) Owner: Theodore Wrubel Applicant: Pamela J. Favreau & Jonathan Jette & Darek Olearczyk (Received March 6, 2012 Public Hearing April 3, 2012 decision by June 5, 2012)
P. Nevers motioned to approve PZC2012-18 Application Special Permit for gift shop, meditation room, Reiki & massage, special events for educational purposes, & Chiropractor’s /Acupuncture office at 8 Tolland Turnpike with the following conditions:  
  • Permit to be annually renewable beginning May 1, 2013.
  • Sign shall be unlit.
  • Hours limited to no later than 8:30 PM.  
E. Standish seconded the motion.  
A discussion was held on the parking.  The commission expressed their concerns on parking and said they have no jurisdiction in regards to parking issues.  If issues arise, it is to be resolved between Track Nine Diner and the applicant.  
A vote was held.  M. Ellis recused himself since he was not at the previous meetings and did not listen to the tape.  All others in favor.  Motion carried.

Special permit for Convenience Store, Alla Zaid
S. Yorgensen will send a letter to the store owner regarding the sign violation.
Renewal of Special Permit for Restaurant, Jeffrey Kelly
P. Nevers motioned to approve the Renewal for Special Permit for the Restaurant.  T. Murphy seconded the motion.  All in favor.  Motion carried.
Renewal of Special Permit for Package Store, Helen Scherwizky
S. Yorgensen said she has called the package store owner but has not received a call back.  S. Yorgensen will send a letter regarding the sign violation.  
A discussion was held on Curves in regards to sign violations.  The Consensus of the Commission was that there were too many signs in the windows (8). S. Yorgensen said they had contacted her regarding temporary banners for 2 weeks and this may be connected.  The Commission said this was not the same issue.
Minutes
P. Nevers motioned to approve the minutes of April 17, 2012.  T. Murphy seconded the motion.  All in favor.  Motion carried.  
Staff Report and Discussion
A letter was read regarding a noise complaint on Baywood Kennels and a discussion was held.  
The fire department has not yet obtained a CO for the addition.  S. Yorgensen said she is waiting on an as-built and plantings that were required at the property line.  S. Yorgensen will send a letter.  
S. Yorgensen received a letter from a sign company regarding temporary banners at TA.  A discussion was held.  
J. Poole asked the commission about the possibility of moving the meetings to 7:00.   A discussion was held.  The meeting start time will put on the next agenda for discussion.
